It’s safe to say that for website owners, 2025 presents new challenges in terms of complying with new online privacy requirements.
A total of nine new privacy laws were implemented in the United States in 2023 and 2024. Now, as we begin 2025, eight more will be added to the list. Clearly, online privacy is increasingly a hot topic here in the USA, not just the European Union.
These eight states have new privacy laws taking effect in 2025:
- The Delaware Personal Data Privacy Act took effect on January 1, 2025.
- Iowa SF262 is in effect as of January 1, 2025,
- The Nebraska Data Privacy Act is in effect as of January 1, 2025.
- New Hampshire SB 255 is in effect as of January 1, 2025.
- New Jersey Senate Bill 332 takes effect on January 16, 2025.
- The Tennessee Information Protection Act will becomes active on July 1, 2025.
- The Minnesota Consumer Data Privacy Act is in effect on July 31, 2025.
- The Maryland Online Data Privacy Act of 2024 becomes effective on October 1, 2025.
Please keep in mind that these privacy laws apply to you even if you are not located in the specified states. Click here for important details about these laws.
Although not every law will affect all businesses, certain laws have a wide-reaching scope and can impact companies of various sizes and locations. If these regulations do apply to your business, it is essential to update your Privacy Policy accordingly in order to include all necessary disclosures. Most laws do have thresholds in place that determine who is subject to the law, usually the business size, or the types of data collected. That said, even if you aren’t directly subject to a specific law, having an actively updated privacy policy has other important benefits.
Indirect benefits of managed website legal policies
Implementing a managed policy set for your business website, even for the smallest business, has unexpected benefits. Besides keeping you on the right side of the law, implementing managed legal policies shows that you’re aware of current digital privacy issues and that you care enough about your visitors and clients to take those concerns seriously. In short, a good privacy policy that is updated frequently builds trust.
The other major benefit is that the process of setting up a managed policy can open your eyes to current requirements and how they impact your online marketing. Common marketing strategies including contact forms, mailing list opt-ins, download offers, pixels, affiliate links and even Google Analytics have an impact on how your policy is written. Changes to your online marketing require a review of your policies to keep you current and in compliance.
